A mandate contract (umowa zlecenie) is more expensive, but it provides health insurance, pension-contribution periods and the possibility of joining sickness insurance. The choice largely depends on whether you already have another insurance title — a job, student status or a pension.

The name of the cooperation is not enough

Before comparing figures, a common misunderstanding needs clearing up. A person running unregistered activity who provides services to a firm under a signed mandate contract or service agreement is, for ZUS, a mandate contractor. The firm must then register them for insurance and pay contributions, as with any other mandate. The biznes.gov.pl portal describes this expressly using the example of a person who has no other insurance title.

Unregistered activity in its pure form is therefore the sale of one's own goods or services performed on the basis of an order and a bill, without a mandate contract. The general conditions of this form, including the quarterly revenue limit — in 2026 PLN 10,813.50 — are described in the article Unregistered activity 2026 — limits, rules and for whom.

What is withheld under a mandate and under unregistered activity

Element

Mandate contract (sole insurance title)

Unregistered activity

Pension contribution

9.76% on the contractor's side and 9.76% on the principal's side

none

Disability contribution

1.5% contractor, 6.5% principal

none

Sickness insurance

voluntary, 2.45%

cannot be joined on this basis

Health contribution

9% of the base

none

PIT advance

12% after 20% costs, withheld by the principal

none, settlement in PIT-36 after the year-end

Minimum hourly rate

PLN 31.40 gross in 2026

not applicable, the price is set by the seller

The details of the mandate contract itself, including the hours log, are discussed in the text on the mandate contract.

Three situations, three different answers

Student under 26

A student or pupil of a post-primary school up to the age of 26 is not subject to social or health insurance under a mandate contract. The mandate is for them almost as "light" as unregistered activity, and in addition the principal takes care of settlement.
