We check the assortment, the 20,000 PLN limit and mail-order sales conditions applicable in 2026.","
The platform on which the sale takes place does not determine the obligation to use a cash register. A seller on TikTok Shop can usually do without one if they ship goods, receive the full payment by bank transfer and are able to assign each payment to a specific order and client. A cash register is, however, necessary from the first transaction when the offer includes an item from the list of exclusions — for example a smartwatch, perfume or an e-cigarette.

Where the cash register obligation comes from

The VAT Act requires sales to private individuals who do not have a business, and to flat-rate farmers, to be recorded on a cash register. The exemptions are set out in the Regulation of the Minister of Finance of 17 December 2024 (Journal of Laws item 1902) on cash register exemptions. The exemptions provided therein apply until 31 December 2027 at the latest.

The cash register obligation does not depend on the VAT status. It also applies to a seller using the turnover-based VAT exemption, and even to a person running sales as part of unregistered business activity who exceeds the exemption limits. Sales to businesses documented with an invoice do not fall within this record.

For a shop in an app, three questions matter in practice. It is worth asking them in the order given, because the answer to the first may settle the matter.

Test 1: whether the assortment is not on the exclusion list

The Regulation lists goods for which no exemption applies — neither the turnover limit nor the mail-order sales exemption. From the point of view of a typical social-media shop, the most common groups are:

consumer electronics — phones, including smartphones, smartwatches, speakers, image or sound recording and playback devices, monitors, memory devices, navigation devices;

computer hardware — laptops, tablets, game consoles, parts for computers and consoles, peripherals;

photo and optics — cameras, lenses, camcorders, binoculars, projectors;

fragrance cosmetics — perfumes and eau de toilette (other cosmetics are not excluded);

smoking and inhalation products — e-cigarettes, liquids and tobacco heaters, as well as tobacco products and alcohol;

jewellery made of precious metals — when its supply cannot benefit from the turnover-based VAT exemption;

automotive — car parts and accessories, trailers, engines.

The effect is twofold. Sales of such goods to a consumer must always be registered on a cash register, even for shipping and bank-transfer payment. In addition, at the moment of the first such transaction, the seller loses the exemption resulting from the PLN 20,000 limit. The remaining assortment shipped on the conditions described below may still be recorded without a cash register, but a cash register will have to appear in the company anyway.

Accessories cause doubts: cases, chargers, cables or holders are not explicitly listed, and their classification depends on the specific product. Before adding such a category to the offer, it is worth checking the classification or considering an interpretation application.

Test 2: whether the sale meets the mail-order conditions

The exemption for mail-order deliveries (item 41 of the annex to the Regulation) requires the simultaneous fulfilment of three conditions:

the goods reach the client by post or courier shipment;

the full payment is received via the post office, a bank or a credit union to the seller's account;

the records and proof of payment unambiguously show what the payment was for and who the buyer is, including their address details.

On TikTok Shop the buyer pays the platform, and the seller receives a collective payout reduced by commission. The platform transfer alone does not say which orders the money came for. That is why the third condition must be actively managed: regularly download the orders and settlements report, link the order number with the amount of the payout, and keep these summaries together with the bank statement. Without such a link, it will be difficult to prove the right to the exemption during an inspection.

The conditions are broken by any cash payment "in hand", for example on personal collection or sale at a fair. Such a transaction is no longer a mail-order sale, and whether it requires a cash register is decided by the third test.

Test 3: the PLN 20,000 limit for the remaining sales

Regardless of the mail-order exemption, the turnover exemption works: no cash register is needed as long as the value of sales to private individuals in a year does not exceed PLN 20,000 net. For a start during the year the limit is counted in proportion to the number of days of sale. Mail-order sales also count towards the limit — they are not deducted, although in themselves they do not require a cash register.

After the limit is exceeded, the exemption expires after two months from the end of the month in which this happened. From then on, every consumer sale that does not meet the mail-order conditions must be recorded on a cash register.

Seller's situation

Is a cash register needed?

Shipping only, payment through the platform, order reports archived

No, regardless of turnover

As above, but perfumes have appeared in the offer

Yes, from the first sale of perfume

Shipping plus occasional personal collection for cash, turnover below PLN 20,000

No, until the limit is exceeded

As above, turnover above PLN 20,000

Yes, for cash sales, after two months from being exceeded

Example: a shop with decorations that wants to expand the offer

Ms Anna sells handmade candles and decorations exclusively through TikTok Shop. Clients pay in the app, parcels are sent by courier, and once a month she downloads an orders report and links it with payouts to the business account. She does not need a cash register even with turnover of PLN 150,000 a year.

In October 2026 she plans to add small wireless speakers to the offer. These are electronics from the exclusion list, so before the first such sale she must install a cash register and record every speaker sold to a private individual. Candles shipped on the previous rules may remain outside the cash register.
